TERMS OF SERVICE

ELIGIBILITY

You must be at least 13 years old to play. If you are under the age of majority where you live, you may only play with the involvement of a parent or guardian who agrees to these terms.

FREE, AND IN EARLY DEVELOPMENT

The game is provided free of charge and is currently in an alpha stage: features are incomplete, bugs are expected, matches may drop, and progress may be reset or lost at any time, including through updates. Do not treat your progress as permanent.

We may change, suspend or discontinue any part of the game — including online play — at any time and without notice. We promise no particular level of availability.

LICENCE TO PLAY

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the game for your own non-commercial entertainment. You may not sell, sublicense or commercially exploit the game or any part of it.

ACCEPTABLE CONDUCT

You agree not to:

• Cheat, exploit bugs, tamper with game state, or use bots, scripts or automated clients to play.
• Reverse engineer, decompile or interfere with the game or its match server, or attempt to gain unauthorized access to any part of it.
• Overload, disrupt or attack the match server, or degrade other players’ experience.
• Harass, threaten, defame or abuse other players, or send content in chat or in a display name that is hateful, sexually explicit, illegal or infringes anyone’s rights.
• Impersonate another person, or pick a display name designed to deceive.
• Use the game for any unlawful purpose.

We may block access to online play for anyone who breaks these rules.

DISPLAY NAMES & CHAT

You are responsible for the display name you choose and everything you send in chat. That content goes directly to your opponent.

We do not store, monitor or moderate chat messages — the match server forwards them and keeps nothing. We therefore cannot retrieve or remove a message after it is sent, and you may encounter content from other players that we have not reviewed and do not endorse. Play accordingly, and do not share personal information with opponents.

ONLINE & PEER-TO-PEER PLAY

The peer-to-peer mode connects you directly to another player. In that mode your IP address is visible to your opponent, and theirs to you. This is inherent to direct connections, and by choosing peer-to-peer mode you accept it. Use the dedicated server mode if you prefer not to connect directly.

VIRTUAL ITEMS

Gold, items, upgrades and other in-game rewards are not property and have no monetary value. They cannot be bought with real money, redeemed for real money, or transferred or sold outside the game. You have no ownership interest in them.

We may adjust, remove, expire or reset virtual items at any time, and owe you no compensation for doing so.

ADS & THIRD PARTIES

The game is supported by advertising served through Google AdSense and relies on third parties for hosting and connectivity. We are not responsible for the content of ads, or for any third-party site you reach by clicking one — your dealings with advertisers are between you and them. You may not click your own ads or otherwise generate invalid ad traffic.

INTELLECTUAL PROPERTY

The game, including its code, artwork and design, is owned by OtoCo WY LLC - Think Strategically - Series 507 and protected by intellectual property law. These terms transfer no ownership to you. Tic-tac-toe as a game concept is of course free for anyone to use.

DISCLAIMERS & LIABILITY

The game is provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the game will be uninterrupted, secure or error-free, or that progress will be preserved.

To the fullest extent permitted by law, OtoCo WY LLC - Think Strategically - Series 507 is not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, progress or goodwill. Because the game is free, our total aggregate liability for any claim is limited to one hundred U.S. dollars (US$100).

Nothing here excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

INDEMNITY & TERMINATION

You agree to indemnify and hold harmless OtoCo WY LLC - Think Strategically - Series 507 from any claim, damage or expense (including reasonable legal fees) arising from your misuse of the game, your content, or your breach of these terms.

You may stop playing at any time. We may suspend or terminate your access at any time, with or without notice, particularly for breach of these terms. The sections on virtual items, intellectual property, disclaimers, liability, indemnity and governing law survive termination.

GOVERNING LAW & DISPUTES

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules.

Talk to us first. If you have a problem, email support@supertictactoe.app and we will make a genuine effort to resolve it informally within 30 days. If that fails, you and we agree to the exclusive jurisdiction of the state and federal courts located in Wyoming.

If you are a consumer resident in the EEA or UK, this does not deprive you of the protection of the mandatory consumer laws where you live, or of your right to bring proceedings there.

CHANGES & CONTACT

We may revise these terms as the game develops; the date above changes when we do, and continuing to play means you accept the revision. If any provision is unenforceable the rest remains in effect, and our failure to enforce a provision is not a waiver of it.
